GENERAL TERMS & CONDITIONS

1. Agreement

Unless a separate written agreement is made, this is a binding agreement between Spitsbergen Explorer AS (hereafter referred to as the arranger) and customer, (as the booker). Otherwise, all laws and regulations relating to tourism on Svalbard apply for package tours and other travel with Spitsbergen Explorer AS.

2. Booking

When the arranger sends confirmation of the booking to the booker, the booking is considered to have been accepted unless the booker gives notice in writing immediately concerning discrepancies or errors in the booking.

3. Payment for individual booking (1- 9 persons)

Payment shall be paid no later than 22 days before the arrangement.

For online booking the payment is fully charged immediately.

4. Changes and cancellation fees for individual booking (1- 9 persons)

Cancellations made up to 22 days prior to activities are refunded 100 percent, apart from an 5% administration fee of the total amount.

Cancellations made from 8 to 22 days prior to activities are refunded 50 percent.

Cancellations made seven days or fewer prior to activities are not refunded.

Only written cancellation is valid. There will not be given any refund due to flight cancellation, lack of a valid driver’s licence, passport or sickness. We recommend our customers to have a valid travel insurance.

5. Payment for group booking (10 persons and more)

Payment shall be paid no later than 120 days before the arrangement.

For online booking the payment is fully charged immediately.

6. Changes and cancellation fees for group booking (10 persons and more)

Cancellations made 120 days or more prior to activities are refunded 100 percent.

Cancellations made 120-91 days prior to activities are refunded 50 percent.

Cancellations made 90 days prior to activities are not refunded.

Only written cancellation is valid. There will not be given any refund due to flight cancellation, lack of a valid driver’s licence/passport or sickness. We recommend our customers to have a valid travel insurance.

7. Changes of orders after confirmed booking

Individuals: Changes after confirmed order confirmation can be done up to 22 days prior to arrangement for a fee of NOK 400, – per change.

Group booking: Changes after confirmed order confirmation can be done up to 120 days prior to arrangement for a fee of NOK 400, – per change.

8. Program changes on a guided tour

Circumstances such as extreme temperatures and rapid changes in the weather can force changes in our programs in order to ensure the safety of our participating guests. In the case of unforeseen circumstances/weather conditions affecting routes relating to the programme, refunds of any amount will not be given. The safety of our guests is always our first priority. Spitsbergen Explorer AS also reserves the right to cancel the activity if the required minimum number of participants is not reached or when the conditions are considered unsafe.

9. Responsibility and liability

Participants are responsible for evaluating whether they are physically and mentally prepared for participation in the booked activities. Participants must obey and adhere to all instructions issued by our tour guides. Guests are not to bring guns or pyrotechnic devices on our trips. Spitsbergen Explorer AS reserves the right to refuse participation on trips if the participant is considered a threat to safety. Snowmobiling requires a valid driver’s license, and the driver cannot be under the influence of alcohol or other intoxicants. If damage to the snowmobile occurs due to negligent driving, the customer can be held responsible and liable.

10. Responsibility and liability – motor vehicles

The participant is obliged to ensure that the driver’s license is valid in Svalbard and Jan Mayen, and to contact the responsible authorities in case of any questions. The guide will check each passenger’s driver’s license and will refuse participation if necessary. No refunds will be given due to an invalid driver’s license.

11. Complaint

If the booker wishes to make a complaint against the product, this should be discussed with Spitsbergen Explorer AS at the earliest opportunity. If the issue cannot be resolved, and the buyer wishes to complain, this must happen as soon as possible after you come home. The complaint must be in writing and no later than one month after the date of the booked activity.

12. Insurance when participating in guided tour

Spitsbergen Explorer AS activities are covered by liability insurance with the insurance company IF Forsikring. We also have guarantees issued from The Governor of Svalbard for expenses in connection with any rescue operations on Svalbard. Spitsbergen Explorer AS is under no circumstances liable for accidents, injuries, damages or loss that is outside the company’s control. The maximum liability on guided tours is NOK 6,000.

13. Misprint and price changes

Spitsbergen Explorer AS is not responsible for typographical errors, and reserves the right to change the program and adjust prices without further notice.
